Penerangan CUEx-Gratia claims refers to any incident occurs whereby loss or damage is incurred but the circumstances are not covered by insurance policy. While Borderline is the case fall within the category of grey area which is not defined in the certificate/ policy. In these cases, consideration is given for ex-gratia/ borderline payments as long as there are strong moral grounds or some mitigating circumstances leading to the loss which the claimants/ beneficiary could not have reasonably foreseen. In some incidents the case is become national issue.


Ex-Gratia/ Borderline Claims Settlement is a process to decide benevolent payments to the claimant/ beneficiary for loss, damage or expenditure incurred where the claimant/ beneficiary has no obligation of any kind or has no legal liability or where the claimant has no right of payment or is not entitled to any form of payments. In this case, payment justification is made based on business decision and case by case.

The person who is competent in Ex-Gratia/ Borderline Claims Settlements shall be able to assess Ex-Gratia/ Borderline case, evaluate the impact of Ex-Gratia/ Borderline case to the company and arrange for Ex-Gratia/ Borderline claims disbursement in accordance with company’s policy, procedures and regulatory requirement.


The outcome of this competency is to conclude and resolve the Ex-Gratia and Borderline case and execute claims disbursement in accordance with company’s policy, procedure, guidelines and regulatory bodies’ requirements.
